Welcome to the website and online store of Ischia Beauty Officine Termali s.r.l.
The terms “Ischia Beauty”, “we”, “our” and “us” used in these Terms refer to Ischia Beauty Officine Termali s.r.l.
Ischia Beauty operates this website and the online store, including the related information, content, features, products and services.
The technological infrastructure of the online store is provided through Shopify.
These Terms and conditions of service and sale govern both the use of the website and purchases made through the online store.
Using the website and placing an order entail the application of these Terms, to the extent relevant.
The processing of personal data is instead governed separately by the Privacy Policy available on the website.
The mandatory rights granted to consumers by applicable Italian and European legislation always remain unaffected.

2. Scope of application
These Terms apply to the use of the website and to orders placed through the Ischia Beauty online store.
The provisions of the Italian Consumer Code (Codice del Consumo) referred to in these Terms apply to customers acting as consumers, that is, for purposes outside their business, commercial, craft or professional activity.
Purchases made for professional purposes may be subject to different rules.
The commercial terms dedicated to the Ischia Beauty professional and B2B channel are managed separately.
3. Capacity to make purchases
To conclude a contract through the store, it is necessary to have the legal capacity required by the applicable legislation.
Where the purchaser is a minor or otherwise does not have full capacity to conclude the contract independently, the purchase must be made with the involvement, authorisation or representation provided for by law.
4. Account and information provided
To use certain features of the website or to complete a purchase, it may be necessary to provide information such as:
- first name and surname;
- email address;
- billing details;
- shipping details;
- information necessary for payment.
The customer is required to provide correct, up-to-date and complete information.
When a personal account is used, the customer is responsible for the proper safekeeping of their credentials and must take reasonable measures to prevent their unauthorised use.
In the event of suspected unauthorised access, the customer is invited to contact Ischia Beauty promptly.
5. Products
The main characteristics of the products are set out on the relevant product pages.
Before purchasing, the customer is invited to review, where applicable:
- characteristics;
- ingredients;
- quantity;
- directions for use;
- warnings;
- information relating to the type of product.
Ischia Beauty takes care to ensure that images, descriptions and representations of the products are as accurate as possible.
The display of colours and details may nevertheless vary depending on the device, the screen and the related settings.
Non-substantial updates to the packaging or graphics of the product may also occur.
Such circumstances do not in any way limit the consumer's right to receive goods that conform to the contract and to the characteristics communicated at the time of purchase.
6. Product availability
The availability shown on the website is updated on the basis of the information held in Ischia Beauty's systems.
Exceptionally, a product may prove to be unavailable after the order has been submitted.
In that case Ischia Beauty will contact the customer and may propose:
- waiting for the product to be restocked; or
- an alternative product.
A different product will be supplied only with the customer's prior acceptance.
Where the customer does not accept the proposed solution, Ischia Beauty will refund the amount relating to the unavailable product and any further amounts due under the applicable legislation.
7. Prices
The applicable prices are those shown on the website at the time of purchase.
For sales to consumers, prices are stated inclusive of applicable taxes, unless otherwise indicated as permitted by law.
Before the order is concluded, the following are shown:
- price of the products;
- any discounts;
- applicable taxes;
- any shipping costs;
- any further applicable costs;
- total amount to be paid.
The pre-contractual information must clearly include the total price, taxes and additional costs.
For shipments outside the European Union, customs duties, import taxes and customs charges may also be applied, as indicated in the Shipping Policy.
Any subsequent price changes do not alter orders already concluded.
8. Promotions and discount codes
Ischia Beauty may periodically offer:
- promotions;
- discount codes;
- price reductions;
- free gifts;
- reserved offers;
- commercial initiatives.
Each initiative may be subject to its own conditions, such as duration, products concerned, minimum amount, number of uses and whether it can be combined with other offers.
These conditions are communicated as part of the relevant initiative.
When a communication constitutes a price reduction announcement subject to the specific rules laid down by the Italian Consumer Code (Codice del Consumo), the prior price is determined in accordance with the applicable legislation. The Italian Ministry of Enterprises and Made in Italy (MIMIT) normally identifies as the reference the lowest price applied to consumers in general during the preceding 30 days.
9. Procedure for placing an order
To purchase through the store, the customer:
- selects one or more products;
- adds them to the cart;
- proceeds to checkout;
- checks the products and quantities;
- enters or checks the required details;
- selects shipping and payment;
- checks the summary of costs;
- confirms the order.
Before finally submitting the order, the customer has the opportunity to identify and correct any errors in the details entered, using the tools made available by the checkout.
Before submitting the order, the customer must be able to know the technical steps for concluding the contract and the means of correcting errors, as provided for by the Italian rules on electronic commerce.
10. Order with an obligation to pay
Before placing the order, the customer is shown the total amount to be paid.
The function used to finally confirm the purchase must indicate unequivocally that submitting the order entails an obligation to pay.
European legislation expressly requires that the consumer acknowledge this obligation at the time of the order.
11. Confirmation and conclusion of the order
After submitting the order, the customer receives an electronic communication containing the summary of the purchase.
The confirmation contains or makes available the information relating to the order placed.
The contract is deemed to be concluded in accordance with the order and confirmation procedure used by the store, without prejudice to the provisions concerning orders subject to payment by bank transfer and to cases in which the order cannot lawfully be fulfilled.
The contractual information required by the legislation is confirmed to the consumer on a durable medium, in accordance with the provisions on distance contracts.
12. Non-acceptance or impossibility of fulfilling the order
Ischia Beauty does not reserve a general right to refuse or cancel orders “for any reason”.
Before the contract is concluded, it may decline to accept an order for objective reasons.
After the contract has been concluded, it may intervene in the order exclusively in the cases permitted by the applicable legislation, for example in the event of:
- impossibility of fulfilling the order;
- supervening unavailability;
- non-payment;
- essential details that are manifestly incorrect or insufficient;
- well-founded suspicion of fraud;
- unlawful use of payment instruments;
- manifest and recognisable technical error;
- obligations connected with product safety;
- prohibitions or restrictions provided for by law.
If a payment has already been received in respect of an order that cannot be fulfilled, the amounts due are refunded without undue delay.
13. Payment methods
Based on the options shown during checkout, Ischia Beauty currently accepts:
- credit and debit cards;
- PayPal;
- Shop Pay;
- Apple Pay;
- Google Pay;
- Klarna;
- bank transfer.
The actual availability of a payment method may depend on the device, the country, the amount of the order and the conditions of the relevant provider.
For electronic payments, authorisation and charging take place in accordance with the procedures of the relevant payment service provider.
When the chosen method involves deferred payments or payments in instalments, as may be the case with Klarna, the specific conditions communicated by the relevant provider also apply.
Ischia Beauty remains in all cases the seller of the products purchased.
14. Bank transfer
In the case of payment by bank transfer, the order remains pending until the funds have been received.
The customer must use the bank details and instructions communicated by Ischia Beauty during or after the order.
If the funds are not received within 7 days of the order, the order may be cancelled for non-payment.
Preparation and shipping may begin once receipt of the funds has been verified.
Where a bank transfer arrives after the order has been cancelled, Ischia Beauty will contact the customer and will return any sums not due.
15. Invoicing
A customer who requires an invoice may provide the necessary details using the functions available on the website.
Depending on the case, the following may be requested:
- name or company name;
- tax code (Codice Fiscale);
- VAT number (Partita IVA);
- address;
- Recipient Code/SDI (Codice Destinatario/SDI);
- further information necessary for electronic invoicing.
The customer is responsible for the accuracy of the details provided.
The invoice is issued in accordance with the applicable tax legislation.
16. Gift Cards
Ischia Beauty Gift Cards purchased through the store are digital and are sent by email.
Gift Cards:
- may be used exclusively on the Ischia Beauty online store;
- do not expire;
- may be used for multiple orders until the balance is used up;
- retain any remaining credit;
- may be used together with discount codes and promotions, subject to specific conditions clearly communicated for a particular initiative.
Gift Cards cannot be voluntarily converted into money or redeemed for cash, except for anything that may be due under mandatory provisions of law.
The purchase of a Gift Card does not limit any rights granted to the consumer by the applicable legislation.
In the event of a refund of a purchase paid, in whole or in part, by Gift Card, the portion originally paid by Gift Card may be re-credited by the same means, in accordance with the technical functionality of the store.
17. Shipping and delivery
The methods, costs and indicative times of shipping are described in the Shipping Policy, available on the website.
Before purchasing, the customer can find out about any delivery restrictions and the payment methods available.
The times indicated are estimates unless a specific deadline has been expressly agreed.
For consumer purchases, the time limits and remedies provided for by the Italian Consumer Code (Codice del Consumo) apply in any event.
18. Passing of risk
When shipping is carried out by a courier chosen or proposed by Ischia Beauty, the risk of loss of or damage to the goods passes to the consumer when the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods.
If the consumer independently commissions a carrier not proposed by Ischia Beauty, the specific rules provided for by law apply.
European rules expressly provide that the risk passes when the consumer takes physical possession, except in the case of a carrier independently chosen by the consumer.
19. Right of withdrawal
For online purchases made by consumers, the right of withdrawal provided for by the legislation applies.
The ordinary period is 14 days, without the need to give a reason.
The conditions, procedures, model form, return costs and refund arrangements are described in the Returns and Refunds Policy available on the website.
In the case of ordinary withdrawal for a change of mind, the direct cost of returning the goods is borne by the customer, as communicated in advance in the Policy.
The right of withdrawal cannot be derogated from or waived in the cases in which the law grants it.
20. Online withdrawal function
For distance contracts concluded through the website, Ischia Beauty also makes available to the consumer an online withdrawal function, easily accessible throughout the entire withdrawal period.
The function is identified by the words:
“Withdraw from contract here”
or by another equivalent and unequivocal wording.
It allows the consumer to provide or confirm at least:
- name;
- information necessary to identify the order or the contract;
- electronic means by which to receive the confirmation.
Before final submission, a function is used that is clearly identified as:
“Confirm withdrawal”
or an equivalent wording.
After submission, Ischia Beauty sends the consumer, without undue delay, an acknowledgement of receipt on a durable medium, for example by email, containing:
- the statement received;
- the date of transmission;
- the time of transmission.
Article 54-bis of the Italian Consumer Code (Codice del Consumo) now expressly provides for this function for contracts concluded by means of an online interface.
Withdrawal may in any case also be exercised by the other means provided for by law.
21. Ischia Beauty commercial extension up to 30 days
In addition to the right of withdrawal provided for by law, Ischia Beauty offers a commercial extension up to 30 days from delivery.
From the 15th to the 30th day, the product must be:
- never used;
- never opened;
- intact;
- complete with its original packaging;
- with the packaging intact and undamaged.
For returns accepted during this period, the price actually paid for the products is refunded.
Neither the original shipping costs nor the return shipping costs are refunded.
The full conditions are set out in the Returns and Refunds Policy.
This commercial extension does not in any way limit the mandatory rights to which the consumer is entitled.
22. Legal guarantee of conformity
Products purchased by a consumer are covered by the legal guarantee of conformity provided for by the Italian Consumer Code (Codice del Consumo).
For new goods, the seller is liable for lacks of conformity that become apparent within two years of delivery.
The consumer is entitled to the remedies provided for by law, in accordance with their hierarchy, including:
- repair or replacement;
- where the conditions are met, price reduction or termination of the contract.
The remedies provided for by the legal guarantee are ensured free of charge for the consumer in the cases established by law.
The legal guarantee cannot be excluded or replaced by the commercial 30-day returns policy.
23. Proper use of the products
The products must be used in accordance with the instructions and warnings shown on the product, on the packaging or in the information made available.
The cosmetic information and content on the website do not replace the opinion of a doctor or other healthcare professional where such an opinion is necessary.
This clause does not limit any liability of the seller, the manufacturer or other parties where such liability cannot be excluded by law.
24. Intellectual property
Unless otherwise indicated, texts, photographs, videos, trade marks, logos, graphic elements, designs and other content of the website are the property of Ischia Beauty Officine Termali s.r.l. or of their respective owners, or are used on the basis of licences or authorisations.
Such content is protected by the applicable Italian, European and international legislation on intellectual property.
It is not permitted to reproduce, distribute, modify, publish or commercially exploit such content without authorisation, except for the uses expressly permitted by law.
The trade marks and elements belonging to Shopify and to other third parties remain the property of their respective owners.
25. Third-party tools and services
The website may integrate tools or features provided by third parties, including services relating to:
- payments;
- shipping;
- reviews;
- maps;
- marketing;
- customer support;
- other e-commerce features.
The use of third-party services may also be subject to the terms and policies of the respective providers.
To the extent that Ischia Beauty remains liable to the consumer under the law for a product, a service or an activity integrated into its own service, that liability is not excluded by the mere fact that a third party is involved.

The website may contain links to websites or resources operated by third parties.
Ischia Beauty does not necessarily control the content, policies or activities of independent external websites.
The customer is therefore invited to consult the terms applicable on the relevant website.
This clause does not limit any mandatory liability of Ischia Beauty provided for by law.
27. Relationship with Shopify
Ischia Beauty uses Shopify as the technological platform that makes it possible to provide and manage the online store.
Sales made on the store are concluded directly between the customer and Ischia Beauty Officine Termali s.r.l.
Shopify is not the seller of Ischia Beauty products.
The use of the Shopify platform may involve the processing of data and the use of technical features provided by Shopify, as described in the relevant documentation and in the website's Privacy Policy.
Nothing in this section limits rights or liabilities that cannot be excluded or limited under the applicable legislation.
28. Privacy and cookies
The processing of personal data carried out through the website is governed by the Privacy Policy.
The use of cookies and other tracking technologies is governed by the information and the consent management tools made available on the website.
The Privacy Policy is not regarded as a contractual clause that the customer is forced to “accept” simply by browsing the website; rather, it describes how personal data are processed in accordance with the applicable legislation.
29. Reviews, feedback and user-submitted content
Where a user voluntarily submits reviews, comments, photographs or other content intended for publication, the user declares that they hold the rights necessary to do so.
Unless otherwise indicated, the user grants Ischia Beauty a non-exclusive, royalty-free licence, to the extent necessary to:
- publish the content;
- reproduce it;
- adapt it technically;
- display it on the website and on Ischia Beauty channels;
- use it in communications relating to the products or the brand,
in compliance with the applicable legislation and the personal rights of the data subject.
The original ownership of the content is not transferred to Ischia Beauty by the mere fact of its submission.
The following content may not be published:
- unlawful content;
- defamatory content;
- misleading content;
- content infringing the rights of others;
- content containing malware;
- content falsely attributed to persons other than the author.
Ischia Beauty may moderate or remove content where there is a legitimate reason for doing so.
30. Errors and inaccuracies
Despite the care devoted to the website, clerical or technical errors may occasionally occur relating, for example, to:
- descriptions;
- availability;
- prices;
- promotions;
- shipping costs.
Before a contract is concluded, such errors may be corrected.
After the contract has been concluded, an error does not give Ischia Beauty an indiscriminate right to unilaterally modify or cancel the order.
Any intervention in a concluded order is carried out exclusively in the cases and in accordance with the rules permitted by the applicable legislation.
31. Prohibited uses of the website
The website may be used exclusively for lawful purposes.
It is prohibited to use the website to:
- violate laws or the rights of third parties;
- introduce malware or malicious code;
- commit fraud;
- impersonate other people;
- unlawfully take or collect personal data;
- interfere with the security or proper functioning of the Services;
- circumvent technical protection measures;
- carry out automated activities that compromise the functioning, security or availability of the website.
Ischia Beauty may take reasonable measures to protect the website and users from such conduct.
32. Automated systems and software agents
Any use of bots, automated systems or software agents must not:
- circumvent CAPTCHAs or security systems;
- deliberately conceal their automated nature where identification is technically required;
- compromise the performance of the website;
- obtain unauthorised access;

Ischia Beauty may restrict automated access where this is necessary for reasons of security, protection of systems or compliance with the law.
33. Suspension or restriction of access
Ischia Beauty may suspend or restrict an account or access to certain features where there are legitimate reasons, such as:

- fraudulent activities;
- security risks;
- unlawful uses;
- obligations imposed by law or by competent authorities.
Suspension of access does not affect rights already accrued in relation to validly concluded contracts, nor the mandatory rights of the consumer.
34. Availability of the website
Ischia Beauty takes reasonable measures to keep the website available and functioning.
It is not, however, possible to guarantee that the website will be entirely free from:
- interruptions;
- maintenance;
- technical errors;
- temporary unavailability.
Any limitations of the online service do not affect the customer's rights relating to orders already concluded.
35. Liability
Nothing in these Terms excludes or limits:
- the mandatory rights of the consumer;
- the legal guarantee of conformity;
- liability for wilful misconduct or gross negligence in the cases provided for by law;
- liability for death or personal injury where it cannot be excluded;
- liability for defective products;
- any other liability that the law prohibits from being excluded or limited.
To the extent permitted by law, Ischia Beauty is not liable for damage arising exclusively from the customer's conduct, unlawful use of the website or use of the product contrary to the relevant instructions and warnings.
36. User's liability for unlawful uses
The user is liable, in accordance with the general rules provided for by law, for the consequences arising from their own unlawful conduct or from the infringement of the rights of third parties.
No general and unlimited indemnification obligation is imposed on the consumer for any activity connected with the use of the website.
37. Assignment
Ischia Beauty may transfer relationships, rights or obligations connected with its business activity exclusively within the limits permitted by the applicable legislation.
Any such transfer may not reduce the mandatory rights of the consumer.
Where the law requires that the customer be informed or give consent, those requirements will be complied with.
38. Severability
Where a provision of these Terms is declared void, ineffective or unenforceable, the remaining provisions will continue to have effect to the extent permitted by law.
The mandatory provisions applicable to the relationship with the consumer prevail in all cases over incompatible clauses.
39. No waiver
The failure by Ischia Beauty to exercise a right does not automatically constitute a definitive waiver of that right.
This provision does not affect limitation periods, time bars or other effects provided for by law.

41. Alternative dispute resolution
Ischia Beauty invites the consumer first of all to contact customer service in order to attempt to resolve any issue directly.
Where a dispute is not resolved following a complaint submitted directly by the consumer, the information required by the applicable legislation will be provided regarding the relevant alternative dispute resolution (ADR) bodies and procedures and, in the cases provided for, it will be indicated whether Ischia Beauty intends to make use of them.
The consumer's right to apply to the competent judicial authority always remains unaffected.
42. Applicable law and jurisdiction
These Terms are governed by Italian law.
If the customer is a consumer resident in another country, any mandatory protections granted by the law applicable in their country of residence remain unaffected.
For disputes with a consumer, the court provided for by the mandatory rules protecting consumers has jurisdiction and, where applicable, the court of the consumer's place of residence or domicile.
43. Changes to these Terms
Ischia Beauty may update these Terms, for example, on account of:
- legislative changes;
- technical changes;
- development of the services;
- changes to the commercial conditions.
The new terms will apply to orders placed after their entry into force.
Changes do not retroactively alter the terms applicable to orders already concluded.
The updated version of the Terms is made available on the website with an indication of the relevant update date.
44. Privacy Policy
Personal data are processed in accordance with the Privacy Policy available on the website.
Some processing operations may involve Shopify and other technology providers necessary for managing the store, payments, shipping, communications and the other features used.
The purposes, legal bases, recipients, retention periods and rights of the data subject are described in the Privacy Policy.
